General Conditions of Sale
We invite you to read these General Conditions of Sale before proceeding with your purchase.
By making a purchase you accept these General Conditions of Sale, which rule the sale of plants by the company Società Agricola Carnosa e Spinosa (from now called “Carnosa and Spinosa”), with registered office in Via Teodora Bresciani, 40 – 25080 Manerba del Garda (BS), Italy.
All contracts of online plant sale of Carnosa e Spinosa are regulated by these General Conditions of Sale, which are approved by the client through the law art. 1341 and 1342 c.c., making an additional and substantial part of each purchase order. The General Conditions of Sale applicable to each purchase order are the ones valid on the date of the order itself.
We consider that all the purchase orders made on this website are made by private clients for their personal use.
Purchase Orders:
- The Product Sale takes place online and from distance. The Order may be modified after purchase only by phone, fax, email, using the contacts provided in the section “Contacts” of this website.
- Each Order is a contractual acceptance by the Client and the sale is considered completed when the Order is registered on this website. The Order will be processed only after the receipt of payment as by law art 6.1. Carnosa e Spinosa will not process incomplete orders, orders not subscribed by the client or not approved in writing.
- In case Carnosa e Spinosa does not process an Order due to unavaibility of a product, Carnosa e Spinosa will inform the Client and will refund the amount received for the purchase of those products. The client will have no right to request further refunds for any reason.
Products:
2.1 The online sale on this website is of potted plants or plants on roots which will be shipped to the client with the methods and time determined by the law art. 4.1. As for other plant types or pot dimensions, the client will have to agree with Carnosa e Spinosa.
Prices:
3.1 The prices of the plants and of the shipping published by Carnosa e Spinosa on this website are valid on the date of the purchase and they include VAT as per the VAT amount valid on the day of purchase. In case of law changes concerning VAT or other taxes, there will be an adjustment in the shipping slip. The shipping cost are calculated based on the weight/volume of the plants and the destination, as explained at point 6.1 in this article.
Shipping:
4.1 The purchase orders will be processed according to the date of receipt and may be delayed due to the climate situation, or due to reasons beyond the responsibility of Carnosa e Spinosa because dependent on the responsibility of the company taking care of the shipment.
4.2 The shipping will be arranged up to the address informed during purchase and up to the closest point that can be reached by the courier. The shipping cost includes the unloading but does not include porterage or transport up to the floor. The seller does not take responsibility for any eventual extra costs due to mistakes made by the client when providing the correct address or contact information during purchase.
Complaints:
5.1 Complaints are only accepted if sent by registered mail within 8 days from receipt of the packages.
Payment Methods
6.1 Payment can be made through:
- Credit Card: Visa, Mastercard, American Express
- Bank Transfer. In this case, it is necessary to indicate the Purchase Order Number and the name of the person who made the purchase.

Invoicing and accuracy of information
7.1 As by the law DPR n. 633/1972, Carnosa e Spinosa does not take responsibility over the accuracy of the information provided by the client in the order form and will issue the invoice accordingly.
Applicable Law and Court
8.1 The Contract of Plant Sale, concluded with the shipping of the order, is to be considered processed and concluded by Azienda Agricola Carnosa e Spinosa and it is governed by the Italian law.
8.2 For any dispute, the court which will take care of the dispute is the Court of Brescia.
Right of Withdrawal
The client has the right to withdraw from the purchase order within 14 days from the day when the product has been received, only through a written request sent by email.
The right of withdrawal can only be exercised trough a written communication to be sent to Carnosa e Spinosa Soc. Agricola – Via Teodora Bresciani 40 – 25080 Manerba (BS), via registered mail, telegram, fax, and must be confirmed and accepted by Carnosa e Spinosa by registered mail within the next 48 hours.
The communication of withdrawal must indicate the Order Number from which the Client wants to withdraw and the method chosen to receive the refund of the amount paid for the Order. The Consumer will have to arrange himself the return of the products, at his own expenses and responsibility. The products must be returned perfectly intact and in their original packaging, within and no later than 10 working days from the receipt of the same.
Carnosa e Spinosa will refund the amount paid by the client within the terms defined by law.
